Rules and Policies

 

All participants of VCF SoCal must adhere to all rules and policies. This is how we can keep VCF SoCal fun, safe, and welcoming for all. These rules and policies govern your use of the VCF SoCal Website (the "Website"), your purchase of tickets for the Vintage Computer Festival SoCal (referred to as "VCF SoCal" or the "Event"), and your attendance at the Event. By using the Website, purchasing tickets, and attending the Event, you agree to be bound by these rules and policies. Please read them carefully before using the Website, purchasing tickets, or attending the Event. All illegal activity is prohibited.

 

The following rules and policies will be enforced during the entire VCF SoCal Event:

REGISTRATION

 

BADGES / WRISTBANDS ("Badges")

  • By registering for a VCF SoCal Badge, you agree not to sell, trade, transfer, or share your promotional code, email confirmation, or Badge. Confirmations and/or Badges that have been sold or provided by anyone other than VCF SoCal will not be honored.

  • To receive Badges, your name must match a valid-government issued photo ID. 

  • To be permitted to any VCF SoCal function, you must wear and present your Badge at all times. Badges will be checked throughout the Event.

  • Anyone who accepts a VCF SoCal Badge agrees to indemnify and hold harmless VCF SoCal from any claim for personal injuries or other damages or equity arising out of any individual's activities at VCF SoCal, even if such injury or damage is caused by negligence by or on the part of VCF SoCal. Anyone who accepts a VCF SoCal Badge agrees to abide by our rules and policies.

 

TICKETS - NO REFUND / TRANSFER / RESALE

  • All sales are final for all ticket purchases and, therefore, non-refundable. All tickets are non-transferable to any other VCF SoCal event. The prices of tickets are subject to change without notice.

  • VCF SoCal reserves the right to change the Refund, Transfer, and Resale Policy at any time without notification.

CANCELLATION AND REFUNDS

In the event of VCF SoCal's cancellation, ticket holders will be entitled to a refund of the ticket price. We will not be responsible for any other costs or expenses incurred by ticket holders. If you fail to attend the Event, no refunds will be provided.

 

ATTENDANCE BY MINORS

A minor is defined as a person under 18 years of age who has not been legally emancipated from their parents. All minors must be escorted by an adult during the Event. VCF SoCal will not assume any responsibility, legal or otherwise, over any minor. Children ages 12 and under enter free with wristband and accompanying adult.

 

EVENT INFORMATION

The schedule of the Event, speakers, and activities at VCF SoCal may be subject to change. We will make reasonable efforts to keep the Website updated with the most current information. Your ticket grants you entry to VCF SoCal for the specified date(s) and time(s). You are required to present your Badge for entry into the Event. Badges are property of VCF SoCal for the duration of the Event and must be presented and/or surrendered to any Staff member requesting it.

 

DISPUTES

You agree that Any dispute related in any way to your use of this Website, purchase of tickets, or attendance of the Event shall be arbitrated by state or federal court in Orange County, California and you consent to exclusive jurisdiction and venue of such courts.

CONDITIONS OF USE

We make reasonable efforts to ensure the accuracy of the information on the Website, but we cannot guarantee the absence of errors or omissions. If you create an account on the Website, you are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree not to use the Website for any purpose that is unlawful or prohibited by these rules and policies. You will not attempt to gain unauthorized access to any part of the Website, the server on which the Website is stored, or any server, computer, or database connected to the Website.

 

PRIVACY POLICY

Before you continue using our Website, we advise you to read our Privacy Policy (link) regarding our user data collection. It will help you better understand our practices.

 

AGE RESTRICTION

You must be at least 18 (eighteen) years of age before you can use this Website. By using this Website, you warrant that you are at least 18 years of age and you may legally adhere to these rules and policies. VCF SoCal assumes no responsibility for liabilities related to age misrepresentation.

 

INTELLECTUAL PROPERTY

You agree that all materials, products, and services provided on this Website are the property of VCF SoCal. You also agree that you will not reproduce or redistribute VCF SoCal's intellectual property in any way, including electronic, digital, or new trademark registrations. For issues regarding intellectual property claims, you should contact the company in order to come to an agreement.

 

INDEMNIFICATION

You agree to indemnify VCF SoCal and its affiliates and hold VCF SoCal harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal limitation on liability. VCF SoCal is not liable for any damages that may occur to you as a result of your misuse of our Website.

PROHIBITED ITEMS

 

ALCOHOL

Possession of alcoholic beverages in the Event space by anyone under 21 years of age (it’s the law) is grounds for expulsion from the Event without refund.

E-CIGARETTES, VAPING PRODUCTS & DEVICES

Traditional cigarettes, pipes, cigars, or E-cigarettes and any vaping product or device are prohibited inside the event center, hotel, and other VCF SoCal venues. You are welcome to step outside the event center to smoke in designated smoking areas only. This policy is in place not only for the comfort of attendees but also to comply with ordinances prohibiting smoking at public events near any doorway, entrance, exit, or operable window. Non-compliance may result in removal from the Event without refund.

FIREARMS

VCF SoCal doesn't allow the possession of any firearms at the Event. Open Carry/CHL/LTC or any other combination doesn't grant permission to bring a firearm onto the premises. Unless you are previously approved Security/Staff for VCF SoCal - please do not bring a firearm into the building. The only exception to this rule will be for off duty peace officers - as we legally cannot deny off duty peace officers’ entry, solely due to their possession of a firearm. However, it will be the responsibility of the off-duty peace officer to identify yourself as such, and provide your badge/ID when requested.

FOOD AND BEVERAGES

No food or beverages are allowed in the main exhibit hall by attendees. This is in order to protect the often fragile and irreplaceable vintage technology that will be on display. If you have brought in food or beverages, you will be asked to leave the venue and allowed to return without the items.

VIDEO, AUDIO, AND PHOTOGRAPH RECORDING

 

To all participants and attendees at VCF SoCal, be aware that photography, audio and video recording may occur. Your presence at the Event, in any areas, grants your permission to be photographed, filmed, and/or otherwise recorded. Your appearance, voice, and name for any purpose whatsoever in connection with VCF SoCal and its initiatives may be used. This may include use on websites, archival, news and advertising, social media, and to the release, reproduction, or publication of any and all recorded media on event grounds.

You waive and release any claims you may have related to the use of recorded media of ‘you’ by entering VCF SoCal or event grounds. This includes, without limitation, any right to review or approve the photo, video or audio recording of you, any claims for invasion of privacy, violation of the right of publicity, defamation, and copyright infringement or for any fees for use of such recorded media.

Understand that all photography, filming and/or recording at VCF SoCal will be done in reliance on this consent. If you disagree, please refrain from entering VCF SoCal or event grounds.

The term "recording" means any media capturing medium or devices, audio, visual, or otherwise. Recording is generally allowed but may be subject to restrictions based on the policies of individual exhibitors, vendors, and speakers. By attending the Event, you inherently grant VCF SoCal permission to use such images or footage for archival, commercial, or promotional purposes. Respect the wishes of attendees, exhibitors and speakers regarding recording.

 

CODE OF CONDUCT

 

All participants are expected to conduct themselves in a respectful and courteous manner. Harassment, discrimination, or disruptive behavior will not be tolerated and may result in removal from the Event without a refund. The VCF SoCal Code of Conduct applies equally to all event attendees, staff, volunteers, speakers, exhibitors and vendors. The policy applies at all VCF SoCal events including, but not limited to, meetings, gatherings, parties, and during pre- and post-show setup/breakdown.

 

VCF SoCal accepts no liability for actions of any kind taken by individuals in the confines of private hotel rooms. Responsibility for incidents occurring in hotel guest rooms rests solely upon the individual in whose name the room is rented. This includes payment for all damage, whether caused intentionally or unintentionally. Please note that if VCF SoCal is provided with sufficient evidence to suggest that illegal activities, particularly those that may cause harm to another person or to the well-being of the Event, will be taking place in a hotel room, we have both a civic and a moral responsibility to report such information to the appropriate authorities. All applicable local, state, and federal laws must be obeyed while in attendance at VCF SoCal.

 

HARASSMENT

VCF SoCal prides itself on cultivating a friendly, diverse, and safe environment for all attendees, speakers, vendors, guests, staff and volunteers. In an effort to do so, VCF SoCal prohibits harassment of any kind, including sexual harassment/assault, and will take appropriate and immediate action in response to this behavior.

 Harassment is any verbal or physical conduct designed to intimidate or pressure, humiliate, threaten, make anyone feel uncomfortable.

 

Harassment includes but is not limited to the following:

​

  • Offensive comments and hate speech in relation to age, race or ethnicity, citizenship, sexual orientation, gender identity or presentation, appearance or body size, pregnancy, veteran status, disability, or religion

  • Deliberate intimidation, bullying, assault, or inappropriate behavior to another person

  • ​Stalking or following

  • Unwanted photography after verbally requesting it to be stopped, clandestine photography or videography for the purpose of exploitation (hidden cameras, etc.)

  • Sustained disruption of events

  • Inappropriate or unwelcome physical contact

  • Unwelcome sexual attention

  • The use of social media to engage in any of the above behaviors while at the Event

 

Participants asked to stop any harassing behavior are expected to comply immediately. The above list is not exhaustive and the VCF SoCal staff are the final arbiter of what else may constitute harassment for the purposes of this policy. 

‍Any form of physical aggression or assault will result in the immediate removal of the offending party without refund, and ultimately, expelled from VCF SoCal and future events.

SEXUAL HARASSMENT

Sexual harassment is defined as "unwelcome sexual advances, requests for sexual favors, and other verbal or physical actions of a sexual nature.” Sexual harassment may take different forms such as:

​

  • Verbal sexual harassment: This includes, but not limited to, suggestive comments, jokes of a sexual nature, innuendoes, sexual propositions, lewd remarks and threats; requests for any type of sexual favor (this includes repeated, unwelcome requests for dates); and verbal abuse that is directed toward a prohibitive form of harassment, including that which is sexual in nature.

  • Nonverbal sexual harassment: This includes, but not limited to, the distribution, display or discussion of any written or graphic material; staring; leering; whistling; suggestive or insulting sounds; content in letters, notes, photos, text messages, tweets and social media posts; obscene gestures; or other forms of communication that are sexual in nature and offensive.

  • Physical sexual harassment: This includes unwelcome, unwanted physical contact, including touching, tickling, hugging, kissing, brushing up against, cornering, groping, fondling, pinching, patting, and forced sexual intercourse or assault.

 

As appropriate and at the offended party’s discretion, a report may also be filed with the local authorities. Sexual Harassment and Sexual Assault are legal distinctions that are outside the scope of VCF SoCal to decide and will be left to the authorities to take appropriate actions.

COVID-19 POLICY

​

COVID-19 restrictions have shifted across the nation. Be advised that all health protocols greatly mitigate but don't completely eliminate the risk of contracting illness. Be mindful of this potential outcome before committing to this or any event.

EXHIBITORS

 

We are very happy to have so many great exhibitors and vendors ("Exhibitors") at VCF SoCal! To make sure we are all on the same page, here are the policies and rules for Exhibitors.

‍Exhibitors must comply with all local, state and federal laws, and will not hold VCF SoCal liable for any breaches, losses, injury, or damage to themselves or their property. All Exhibitors agree to hold blameless VCF SoCal and all VCF SoCal staff members and volunteers against any loss, damage, theft, expenses, claims or actions arising from any personal or property damage, loss or theft due to said Exhibitor's participation in VCF SoCal. Exhibitors should take reasonable measures to secure their items before they leave their tables/booths at night (Main Exhibit Hall doors will be locked by hotel staff overnight). Exhibitors are responsible for their own security during show hours. Tables/Booths must remain intact and manned throughout the hours of the Event and may not be dismantled prior to the closing of the Event without authorization from VCF SoCal. VCF SoCal will not be held responsible for any issues arising from an unmanned table/booth during show hours. Additionally:

  • VCF SoCal will NOT provide or maintain insurance coverage for Exhibitor's persons or property, and it is the Exhibitor’s sole responsibility to obtain insurance covering the loss.

  • VCF SoCal does not endorse any Exhibitor’s merchandise, exhibits, views, beliefs, or actions. All merchandise bought or sold at VCF SoCal is done strictly between Exhibitors and attendees, VCF SoCal is NOT party to or responsible in any way for any transactions made between said parties.

  • No outside food vendors are allowed.

  • California Sales Tax is the responsibility of the Exhibitor to collect according to state laws. In order to be in compliance with the State of California, you will need to register for a California Sales Tax Permit, if you don't already have one, here: https://cdtfa.ca.gov/taxes-and-fees/sutprograms.htm. "Temporary Sellers" can register for a temporary seller’s permit here: https://cdtfa.ca.gov/industry/temporary-sellers.htm. VCF SoCal is not responsible or liable for remittance of Exhibitor's California State Sales Tax. All Exhibitor's are responsible for filing their own sales tax returns with the State of California.

  • No Exhibitor may block or interfere with other exhibits, aisle space, or emergency exits.

  • Any damage caused to the building or its furnishings by the Exhibitor are the sole responsibility of the Exhibitor.

  • All sales are final for purchases of table/booth space and, therefore, non-refundable. All tables/booths are non-transferable to any other VCF SoCal event. This also includes all Badges. VCF SoCal reserves the right to change the Refund, Transfer, and Resale Policy at any time without notification.

  • Abandoned Property: Any property not removed from the venue that has not been claimed within two (2) hours following the end of the Event will be considered abandoned by the Exhibitor.

  • VCF SoCal reserves the right to change, amend, and add to the rules and regulations of the Event at any time. In the event that new rules are added that prevent you from selling your core product, you will be notified and refunded in full.

  • Anyone selling unauthorized merchandise that infringes upon the copyright or licensing agreements of others will be asked to leave the Event. No refunds will be given if you break this rule and are asked to leave.

VCF SoCal reserves the right to edit, modify, and change these rules and policies at any time. Any changes will be effective immediately upon posting on the Website. It is your responsibility to review these rules and policies regularly.
